A pair of intellectual property companies were denied their bounty by a single-member panel of the World Intellectual Property Organization, after the panel ruled the companies, JHO Intellectual Property Holdings, LLC and Elite IP Holdings LLC, both Florida corporations, were guilty of Reverse Domain Name Hijacking in their attempt to acquire the domain noo.com from its current registrant, Mahad Taheri.
The complainants, represented by an affiliate company, Vital Pharmaceuticals, Inc., recently acquired trademarks for brands that include the ‘noo’ word mark; however, Mr. Taheri has been the holder of the noo.com domain since 2005, predating the trademarks by 15 years.
The panelist, Christopher S. Gibson, was unforgiving in his ruling, writing that the complainant appeared to ignore the obvious when filing its UDRP case. “The Panel finds that the facts in this case demonstrate Complainants knew or should have known after reasonable investigation that their claim was baseless and they could not succeed,” he wrote.
The WIPO ruling was handed up February 16, 2021.
