Upstart Gets Slapped With RDNH Trying To Steal UpTerra.com

A freshly-incorporated business with a brand-new trademark has been hit with a ruling of Reverse Domain Name Hijacking by a panel of the World Intellectual Property Organization for attempting to use the UDRP process to force the transfer of the domain upterra.com. UpTerra Corporation, which incorporated in 2022, and has a 2024 U.S. trademark for the mark ‘UPTERRA’, filed the complaint in August after failing to acquire the domain from its current registrant, according to the WIPO ruling.

A three-member panel, composed of members John C. McElwaine, Kimberley Chen Nobles and David E. Sorkin, handed up a ruling of RDNH against UpTerra on October 7, 2024.
