The owners of an upstart company, which aimed to provide financial services of some type via a specialized app, have been hit with a ruling of Reverse Domain Name Hijacking for filing a UDRP to gain control of the domain stable.com, which had recently been acquired by its current registrant for just over $1-million. Stable App LLC, which is connected to the Columbian firm, Ark House S.A.S., a Bogata-based company that defines itself, in its Instagram profile, as promoting “convergence within the cultural and creative industries.” The phrase has been translated from Spanish, using Google Translate.
In his ruling, the sole panelist of the World Intellectual Property Organization noted Ark House filed a trademark for the mark “STABLE” on behalf of its associated company, which did not yet exist, well after the current registrant of stable.com acquired the domain.
That panelist, Warwick A. Rothnie, handed up his RDNH ruling on August 28, 2023.
