Swiss Businessman Hit With Second RDNH In As Many Weeks

Case Number: D2023-4104

Complainant: Patrick Schur

Represented by: Gearhart Law

Patrick Schur, the Swiss businessman recently found guilty of Reverse Domain Name Hijacking, has been found guilty of a second RDNH in as many weeks, this time for his attempting to snatch a different domain name. A single member panel of the World Intellectual Property Organization found Schur had filed his most recent complaint in bad faith, as he attempted to force the transfer of the domain ibubble.com.

The panelist, Adam Taylor, handed up his ruling of RDNH against Mr. Schur on November 24, 2023, only ten days after another single-member panel at WIPO found Mr. Schur guilty of RDNH for trying to hijack the domain demoji.com.

Taylor even noted the first case in his ruling, writing, “[T]he Complainant again unsuccessfully relied on the “Updated On” status date in the WhoIs record as evidencing the respondent’s alleged acquisition of the domain name after accrual of his trade mark rights.”
