International pharmaceutical company Sanofi, based in France, has been found guilty of Reverse Domain Name Hijacking for attempting to use a UDRP to grab the domain initiv.com. Specifically, panelist Adam Taylor, the sole panelist writing the decision, determined Sanofi attempted to deliberately mislead the World Intellectual Property Organization in its filing. The company was handed the RDNH ruling on July 23, 2022, despite the fact the domain owner never responded to the UDRP.
Mr. Taylor added he believe the attorneys representing Sanofi, Selarl Marchais & Associés, also based in France, may have undertaken the task of attempting to mislead the panel. “[W]hile it has imputed the actions of the Complainant’s representatives to the Complainant, the Panel acknowledges that the Complainant may well be unaware of the attempted deception undertaken in its name and that the fault may lay entirely with the Complainant’s representatives,” Taylor wrote.
