Rush To File UDRP Earns Promo Printer RDNH On RushOrderTees.co And RushTees.com

Printfly Corporation, which operates the promotional goods website, RushOrderTees.com, has been found guilty of Reverse Domain Name Hijacking in connection with its effort to use the UDRP process to hijack the domains rushtees.com and rushordertees.co. PrintFly’s branded company advertises that it is a promotional partner of the Philadelphia 76ers basketball club. In presenting its arbitration case before the National Arbitration Forum, PrintFly argued its 2018 trademark on the term “rush order tees” had created an accrual of rights to the domains.

However, the domains were registered in 2009 and 2011, long before any trademark was issued, and by a competing promotional print company. Consequentially, the lone panelist of the arbitration panel, David L. Kreider, handed up a ruling of RDNH against PrintFly on November 14, 2024.
