RDNH Ruled As Dutch Robotics Company Tries To Take Smart-Robotics.com

Case Number: D2021-2259

Complainant: Smart Robotics, B.V.

Represented by: Taylor Wessing N.V.

Smart Robotics B.V., of the Netherlands, has been found guilty of Reverse Domain Name Hijacking for trying to steal the domain smart-robotics.com using the UDRP process. A single-member panel of the World Intellectual Property Organization handed up the RDNH ruling against Smart Robotics on September 17, 2021, even though the domain owner, Mary Anne Wheland, never responded to the complaint.

In issuing his ruling, panelist Tony Willoughby wrote a lengthy ruling detailing his reasoning behind issuing the ruling of reverse domain name hijacking. “Extraordinarily, the Complaint made no reference to the dictionary nature of the Domain Name,” Willoughby wrote, “nor did it begin to explain how a registrant could have been targeting a complainant, which only came into existence several years later.”

Smart-robotics.com was registered in 2009, but Smart Robotics B.V. did not exist at the time.
