An Indian pharmaceutical company has been found guilty of Reverse Domain Name Hijacking for attempting to use the UDRP process to transfer the domain zydus.com from its owner, claiming trademark rights that predated the domain name registration in 2004. However, a three-member panel of the World Intellectual Property Organization found the company, Zydus Lifesciences Ltd., was attempting to impel the panel to draw an inference of trademark dating to 1952, an effort the panel regarded as clear misrepresentation of the facts. Further, Zydus had been known primarily in Indian, and until recently had been trading under the name of Cadila Pharmaceuticals and Cadila Healthcare. Zydus had been a product of the pharmaceutical company.
The panel specifically addressed the company’s attempt at misdirection, as it handed up its RDNH ruling on June 24, 2022. “The Panel is … of the view that the sheer volume of material produced by the Complainant, without a proper referencing to indicate the key parts of this material, tended to obfuscate matters,” the decision reads.
