A Colorado company incorporated in late 2017 as Canon City Property Management, LLC has been found guilty of Reverse Domain Name Hijacking by a single-member panel of the National Arbitration Forum, which found the company clearly pursued its UDRP case in bad faith after failing to purchase a domain from the owner who had registered it in 2016. The property management firm, represented by attorney Chad G. Clark, even include a supplemental trademark registration from the United States Patent and Trademark Office, suggesting the supplemental registration somehow conveyed rights in the domain name. The panelist, Nathalie Dreyfus, handed up her ruling of RDNH on May 4, 2022.
In issuing her ruling, Ms. Dreyfus stated there were multiple prongs of obvious failure present in the UDRP filing, not the least of which was the domain predated the complainant’s existence. Ms. Dreyfus also cited the company for a blatant “Plan B” UDRP filing. “[T]he filing of the present dispute by Complainant has been done with the sole purpose of trying to obtain the transfer of the disputed domain name that Respondent refused to sell,” she wrote.
