French Company Hit With UDRP Trying To Net SmartCatch.com

A French company that was once attached to a university has been found guilty of an attempt at Reverse Domain Name Hijacking for using the UDRP process to try to acquire SmartCatch.com, which has been registered since 2004. The respondent in the case, who is privacy protected, claimed the company was simply trying to avoid paying a market price for the domain.

A three-member panel of the World Intellectual Property Organization found in favor of the respondent, in part on those grounds, following a delay in the case, which had been prompted by settlement negotiations between the two parties.

The panelists, Steven Maier, Nick J. Gardner and Christiane FĂ©ral-Schuhl, handed up their RDNH ruling on May 15, 2024.
