A company based in Cyprus, Nobli Ltd., which only incorporated in November 2021, has been found guilty of Reverse Domain Name Hijacking while trying to transfer the domain nobli.com using the UDRP process. The respondent, Cykon Technology, currently owns the domain, which was originally registered the domain 2009. That fact, alone, was enough to earn the complainant the RDNH, according to the sole WIPO panelist writing the ruling. The panel handed up its decision on September 26, 2022.
Panelist Andrew F. Christie wrote that the complaint had been brought with only the “barest of allegations”, and no evidence. Christie also noted the complainant had “clear knowledge of a lack of respondent bad faith such as due to registration of the disputed domain name well before the complainant acquired trademark rights.”
