A Spanish company and its affiliate enterprise, filing as joint-complainants, have been found guilty of Reverse Domain Name Hijacking for trying to use the UDRP process to grab the domain bookker.com. The parent company, Bookker Corporate S.L.U., and its affiliate, The Graffter S.L., were found to have used the UDRP process as a “Plan B” approach to acquiring the domain from HugeDomains.com, where the domain is currently listed for sale. A three-member panel of the World Intellectual Property Organization found the two companies guilty of RDNH on March 10, 2022.
While both companies have trademarks for the mark “BOOKKER”, neither of them has a registration that predates the domain registration. The earliest trademark was registered in 2017, while the domain was acquired by its current owner in 2014. The panel accused the complainants of trying to specifically mislead the panel on this point, when they wrote, “Nobody knows better than the Complainants that they do not have earlier rights than the Respondent – and yet, this is what they stated in the Complaint, and certified their statements.”
