Viking Exchange & Marketing Inc., which operates in the adult entertainment industry, has been found guilty of Reverse Domain Name Hijacking for attempting to use the UDRP process to impel the transfer of the domain voyeur-house.tv. The complainant argued the domain directly imposes upon a trademark the company has for the single-word mark, “VOYEURHOUSE”.
The respondent, which operates a competing adult video service online, via the domain, argued it acquired the domain in 2015, well before the trademark rights of Viking had accrued. Records for the trademark, from the U.S. Patent and Trademark Office, show the registration was granted on September 23, 2024.
For its part, Viking filed the UDRP on September 5, 2024, wholly 18 day before the trademark registration went live.
A single member panel of the National Arbitration Forum handed up a ruling of RDNH against Viking on October 4, 2024.
